Terms of Service

This Membership Agreement (“Agreement”) is effective between the Member and Cannabis Business Organization (“CBO”) upon the first day the Member joins the organization.  Member shall refer to the individual accessing CBO, the individual accessing on behalf of a business entity and any such business entity itself.  These terms and conditions govern your participation in all matters related to CBO.

By selecting I Accept during the membership registration, you represent that you have read, understand and agree to be bound by the terms and conditions of this Membership Agreement hereinafter referred to as Agreement.

Nature of the Service
CBO is a network facilitating the exchange of information between people.  This socialization shall include reading members business information and possibly even contacting them directly.  CBO provides its members benefits such as but not exclusive to networking and access to potential financial resources.

Website Usage
CBO makes reasonable efforts to ensure that CBO Website operates as intended, however, is dependent upon the Internet and other services and providers outside of the control of CBO.  By using the Website (this includes outward and inward facing sites), you acknowledge that CBO does not and cannot guaranty that the operation of the Website will be uninterrupted, error free or that the Website and the information it contains will be entirely free from viruses, hackers, intrusions, unscheduled downtime or other failures.  You expressly assume the risk of such problems by using the Website or by downloading or uploading information from or to the Website.

User Registration and Information
Members shall fill in the correct information requested in the User Registration form on the site.  Member shall be required to promptly update the User Information on the site.  Member shall select a username and password during the User Registration process.  Member shall be responsible for:  a) all use of the Website made by the Members username and password, and b) maintaining the confidentiality of the Member username and password.  Members are responsible for their own account settings, including privacy settings.  If an individual is joining CBO on behalf of a business entity, by doing so, such individual represents that they have the legal capacity and authority to bind such business entity to the terms and conditions contained in this document.

Members should periodically review these Terms as the Organization may revise them from time to time as may be necessary.

Content
The Content includes messages and other materials posted to forums (“Forums”) such as bulletin boards, discussion forums, or blogs, which allow users to post messages and/or comments to other posted messages. Member of CBO is deemed to grant CBO the nonexclusive right to post, display, copy, and modify the Content in connection with the operation of the Site and CBO business.  Further, the Member is deemed to grant CBO the nonexclusive right to post, display, copy, and sell the Content within the limitations set by the Member during the online publishing process.  Member is also deemed to authorize CBO to disclose his/her personal data when the Member includes such personal data in the content.

CBO has no obligation to, but may, monitor the Forums.  CBO does not control the messages, information or files delivered via its Forums.  By using the Forums, Members agree 1) not to restrict or inhibit any other user from using and enjoying the Forums, 2) post or transmit any information, software or other material which violates or infringes upon the rights of others, including material that is, or deemed to be, an invasion of privacy or publicity rights or which is protected by copyright, trademark, or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder, 3) or post any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation, any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law.  CBO also reserves the right to edit, refuse to post and/or remove any information or materials, in whole or in part, that, in CBO’s sole discretion, are objectionable or in violation of the Terms stated throughout this document.

Throughout the site, hyperlinks to non-CBO sites are provided for all Users convenience.  Such external Websites contain information created, published, maintained, or otherwise posted by institutions, organizations and businesses independent of CBO.  CBO does not endorse, approve, certify, or control any external Web sites and does not guarantee the accuracy, completeness, efficacy, or timeliness of information located at such Websites.

Release & Limitation of Liability
Members expressly acknowledge that any business decisions made by the Member as a result of information obtained through CBO is done so at the Member’s own risk based on independent research and analysis.

If the Member has a dispute with one or more other Members, the Members shall release CBO (and its officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Member shall not hold CBO responsible for other user Members content, actions or inactions.

Privacy
CBO shall not sell or rent Members personal information to third parties without Members consent.  CBO shall store and process Members information on computers located in the United States that are protected by physical as well as technological security devices.  However, Members shall be permitted to access and modify their account information.

Indemnity
Members shall indemnify and hold CBO (and its officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Members breach of this Agreement, or Members violation of any law or the rights of a third party.

No Agency
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Membership Dues
The period covered by annual dues equals one calendar year or 365 days.  Renewals are due by midnight on the last day of the calendar year.  Members are permitted to maintain their initial yearly due charges as long as dues are kept up to date and there is no break in renewal from year to year.  For new members, and Members who have passed their renewal date, CBO reserves the right to increase the annual dues for membership.

Re-occurring and incidental charges are conducted through PayPal services.  Members authorize CBO’s third party billing administrator to electronically and automatically bill their bank or credit card company for payment.  The billing may apply to dues, events, or other offered opportunities.  The Member maintains full control and privacy over their accounts at all time.  For re-occurring billing which is returned for non-payment, and incidental service charge of up to $30 for each returned billing may be charged and the membership will be cancelled until fees are paid.

Conduct
Organization members are expected to conduct themselves in a responsible manner.  This includes honest and ethical business dealings, abiding by state and local laws, providing a safe working environment for employees, and demonstrating professionalism and respectful communications.

Terminating Membership
Members who wish to terminate membership must provide written verification to CBO.  CBO will terminate membership within five days of confirmation of receipt of such notice.

Members shall choose to retire or delete the their published content from the Community’s site and it shall be no longer available or visible to other visitors.  Terms regarding the status of the uploaded content shall remain applicable when the Member chooses to terminate the membership.  Contents posted to the site, other than the published content, shall not be deleted or retired as a result of the Members termination.

CBO reserves the right to suspend, limit or terminate Members ID and password, or all or a portion of your access to the Website, or cancel membership enrollment at any time with or without notice, for any violation by the member of the provisions set forth within the agreement.  The member will not be eligible for an annual membership fee refund under these circumstances.

Refunds
Refunds can be granted within five days of annual membership purchase.  Written request is required.

Usage Limitations
Use of the business advisory service may be subject to limitations, including but not limited to the number of calls and staff time allotted per member.

Age Requirement
Members and guests must be at least 21 years of age.

Governing Law
This Agreement shall be construed under the governed in accordance with the laws of the State of Colorado.  You hereby consent to the exclusive jurisdiction and venue of courts in Denver County, Colorado, USA, in all disputes arising out of or relating to the use of this Website or CBO membership.

Arbitration
Any dispute arising under this agreement shall be resolved under the commercial arbitration rules of the American Arbitration Association.
